General Release and Consent Agreement
To participate in Fall in MalayaLove's Speed Dating Event or After Party Event (“Event”), I agree to be bound by this General Release and Consent Agreement (“Agreement”) and confirm that I have fully read this Agreement.
By purchasing my Event ticket, I affirm that I have thoroughly read all 4 pages of the Agreement, thereby entering into a binding agreement between myself and Fall in MalayaLove LLC (“FIM”). I agree to be bound by every clause in the agreement. In addition, I confirm that I have fully read and am bound by the Terms of Service.
By purchasing my event ticket to attend the Speed Dating event, I explicitly agree that I have submitted an application for the Event and that I received an approved invitation by FIM to purchase my ticket.
If it is discovered that there was a material discrepancy, such as a deliberate misrepresentation of personal information conveyed during the Speed Dating or any other application process, FIM reserves the right to revoke the ticket or refuse entry without a refund.
By purchasing my event ticket to attend the Speed Dating Event or After Party, I explicitly agree that I have purchased an authorized ticket through FIM.
If it is discovered that any Event ticket has been purchased for or by an unauthorized guest, FIM reserves the right to revoke the ticket or refuse entry without a refund. FIM reserves the right to refuse entry to the Event to anyone for any reason.
In the event that I have received prior notification of a ban from all FIM events, whether in writing or verbally from a FIM representative, I understand that I am prohibited from attending the Event and prohibited from purchasing a ticket to any Event. In the event that an unauthorized ticket has been purchased, FIM reserves the right to revoke the ticket or refuse entry without issuing a refund. I acknowledge that any attempt to gain entry into the Event will also result in denial at the door.
I certify that I am at least twenty-one years old and that if attending the Speed Dating event as a participant, I am unmarried. I affirm that I am able to provide a government issued ID upon entry to confirm my identity and age. By purchasing my event ticket, I represent and warrant that I have the right, authority, and capacity to enter into this Agreement and to abide by all the terms and conditions of this Agreement. I certify that any and all information I have provided to FIM is true, complete, and accurate in all aspects.
I understand that FIM does not guarantee that any participant will successfully match with another participant. I understand that I am solely responsible for my interactions with other participants. In addition, I understand that FIM holds no responsibility for the outcome of any relationship that may or may not form between myself and any individual I meet as a result of the Event.
FIM does not make any representation or offer any assurances with respect to other participants. FIM does not run criminal or civil background checks on participants or verify any personal information including, but not limited to, general background, marital information, character, physical or mental health. By purchasing my Event ticket, I affirm that it is my complete and sole responsibility to perform these actions, if desired, to my satisfaction. Further, I agree to take all necessary precautions in all interactions with all other participants.
I understand that dangers exist with respect to the Event due to many factors, including, without limitation, my own actions or inactions, the actions or inactions of others participating in the Event, the weather, event space, landscape, terrain, and other prevalent conditions. I am aware that the Event may be conducted on spaces and/or in facilities open to the public. If at any time I believe that the conditions surrounding the Event, including the actions of others, are unsafe to me, I will immediately discontinue further participation in the Event. I fully understand that: (a) the Event, travel to and from the facilities at which the Event is held (the “Facilities”), and my presence on, at, or in the Facilities involve physical and other risks and dangers, including, without limitation, risk of serious bodily injury, including permanent disability, blindness, emotional distress, paralysis, and death (all such risks and dangers, collectively, “Risks”); (b) these Risks may result from a number of factors, including, without limitation, my own actions or inactions, the actions or inactions of others participating in or viewing the Event, the weather, landscape, terrain, and other prevalent conditions, and the negligence of one or more “releasees,” as defined below; (c) harm to me may result from the negligence of FIM or its volunteers, one or more Releasees (as defined below), or others, from the condition of the Facilities, or from my own actions or negligence; and (c) there may be other risks arising from or related to the Event, and social and economic losses, either not known to me or not readily foreseeable at this time. I acknowledge that I understand and appreciate the potential risks involved. I voluntarily and fully accept and assume (a) all risks, hazards, and dangers to me, including, without limitation, (1) the possibility of personal injury to, death of, and partial or permanent disability of, me, and (2) the possibility of damage to my property and other loss resulting from my participation in the Event, travel to and from the Facilities, and my presence upon, in, or at the Facilities and (b) full responsibility for all injury, losses, costs, expenses, liabilities and damages incurred as a result of or in connection with my participation in any way in the Event, travel to and from the Facilities, or my presence on, at, or in the Facilities.
I acknowledge that photographers and videographers will be present at the event to document all aspects of the Event, including my participation in the Event. I hereby authorize and give my full consent to FIM to copyright and/or publish any and all photographs, videotapes, other image captures, and/or film in which I appear in the background only, and not as a sole subject, while attending the Event.
I understand that FIM will not publish solo photographs of me at the Event in association with any promotional material or social media posts, without my explicit and written authorization. In addition, it is understood that my name, status, association, or image captures when featuring me as the sole subject, shall not be utilized for marketing, promotional, or advertising purposes, unless my explicit and written authorization is granted.
I acknowledge that I am not entitled to compensation and hereby waive any right to inspect or approve the finished photos, video footage, advertising copy or printed or web matter that may be used in connection therewith, or to the eventual use that it may be applied. Further, I agree to release FIM from any claim related to the use of my name, photo, videography or other image capture or statement provided by me related to your participation in the Event. This includes, without limitation, claims for slander, libel, defamation, violation of privacy, publicity, personality, and/or civil rights, depiction in a false light, intentional or negligent infliction of emotional distress, copyright infringement, and or any other tort and/or damages arising from or in any way relating to my participation in the Event and/or use of my name, voice, and/or likeness in connection with the Event or the promotion thereof in all media now known or hereafter devised.
All title, ownership and intellectual property rights, including the rights to copyright, trademarks, service marks and logos (collectively, the “Intellectual Property”) are vested to Fall in MalayaLove, LLC. Nothing contained herein should be construed as granting, by implication, estoppel or otherwise, any license or right to use any of the Intellectual Property without the written permission of FIM.
I agree to observe and obey all posted rules and warnings and further agree to follow any oral or written instructions or directions given by FIM or the employees, founders, volunteers, vendors, representatives, or agents of FIM. I further agree to obey all applicable laws and regulations while at the Event.
I agree to pay for all damages to the event facilities caused by my negligence or my reckless or willful action.
I understand that FIM has the right to deny access or eject anyone from the Event. I further understand that if I am refused admission or removed from the Event, I am not entitled to any compensation of any kind or to a refund of the registration fee. Reasons for refusal of entry or ejection from the Event, include, but are not limited to:
- Inappropriate behavior towards the participants, the hosts, volunteers, vendors, or the employees on site,
- Rowdy or disruptive behavior, including inebriation
- The dissemination of personal data of other participants or volunteers
- Violation of set rules, or
- Any reason the host deems sufficient
I affirm that unauthorized guests are strictly prohibited from attending the Event. I acknowledge that FIM considers any attempt to invite unauthorized guests to “crash” the Event as an act of trespassing. FIM reserves the right to take legal action to the fullest extent permitted by law against individuals who violate this policy, including those who committed the act of trespassing, as well as the invited guests who supported or facilitated such actions.
I acknowledge that the purchase of my Event ticket is non-refundable. Nonetheless, in the event of unforeseen circumstances, I am aware that I may seek a replacement candidate, subject to approval by FIM event organizers. I understand that I must inform FIM at least 15 days prior to the event date for consideration of such a transfer. FIM does not guarantee the transfer of tickets but will make reasonable efforts to accommodate such requests.
I waive any and all Claims, as defined below. I release FIM, its volunteers, and vendors from all liability arising from my participation in the Event, including liability for injuries arising from negligence of FIM, its founders, volunteers, or vendors. I hereby release, discharge, and agree to hold harmless FIM and its administrators, founders, directors, agents, officers, volunteers, employees and members, all other participants in, sponsors of and advertisers for the Event, and all owners, operators, lessors, and service providers of or for the premises in or on which any event takes place (each, a “Releasee”) of, from and against any and all claims, actions, demands, injuries, losses, costs, expenses, liabilities and damages resulting or arising from, or incurred in connection with, the Event, my participation in the Event, transportation of me to or from the Facilities, or my use of, or presence upon, at, or in, the Facilities (each, a “Claim”), however caused, whether caused by the fault of myself, FIM, or one or more third parties, including, without limitation, any Claim caused by, resulting from, or arising from, or alleged to be caused by, resulting from, or arising from, in whole or in part, the negligence of any Releasee, including liability for injuries arising from negligence of FIM, its employees, or any other releasee and including any negligent rescue operation.
Further, I hereby covenant not to sue FIM or any other Releasee in regard to any Claim, including, without limitation, any Claim caused, resulting, or arising from, or alleged to be caused, resulting, or arising from, in whole or in part, the negligence of FIM or any other Releasee.
I agree to indemnify, hold harmless, and defend each Releasee of, from, and against all claims, causes of action, losses, costs, expenses, damages, judgments, and liabilities, including, without limitation, all attorneys' fees and other costs and expenses of litigation, that may in any way be a result of, arise from, or be related to, my participation in the Event, presence at, upon, or in the Facilities, or transportation to or from the facilities.
I acknowledge and agree that by providing my mobile phone number in the application process, I may receive SMS text messages from FIM related to my participation in the event, including reminders, updates, confirmations, and other event-related communications. I understand that message frequency may vary, that message and data rates may apply depending on my carrier, and that I may opt out of receiving such messages at any time by replying “STOP” to any message.
These terms and conditions shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, it shall not affect the validity and enforceability of any other remaining provisions.
I expressly agree that this General Release and Consent Agreement is intended to be as broad and inclusive as is permitted by relevant law.
By purchasing my event ticket, I acknowledge that I have read all 4 pages and understand this Agreement, and am executing it knowingly, voluntarily and free from any coercion or duress. I agree to abide by all of its terms. I understand that this is a legal agreement that is binding upon me, my heirs, executors, administrators, successors and assigns. This General Release and Consent Agreement shall be effective from and including the date of my ticket purchase.
